Terms of Service

1. Acceptance of Terms
By accessing or using HyperXI ("the Service"), operated by Escape Tech Enterprises LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. Your continued use of the Service following the posting of changes to these terms constitutes your acceptance of those changes.
2. Service Description
HyperXI is a software-as-a-service (SaaS) booking platform designed for escape room businesses. The Service provides online booking management, scheduling, customer management, payment processing, and related tools. The Service also includes API access and MCP (Model Context Protocol) server access for programmatic integration with supported AI assistants and third-party applications.
3. Account Registration
To use HyperXI, you must register a tenant account and designate at least one administrator. The tenant administrator is responsible for managing access to the tenant account, including adding and removing employees and configuring account settings. You agree to provide accurate and complete registration information and to keep that information current. You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your login credentials.
4. Subscription & Billing
HyperXI offers a free tier with limited features and paid subscription tiers with additional capabilities. Paid subscriptions are billed on a recurring basis (monthly or annually, depending on the plan selected). All paid plans auto-renew at the end of each billing cycle unless you cancel before the renewal date.
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you will retain access to paid features until that date. We do not provide prorated refunds for partial billing periods. We reserve the right to change pricing with at least 30 days' notice before the change takes effect on your account.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Abuse, overload, or interfere with the API or any other part of the Service infrastructure.
- Scrape, crawl, or use automated tools to extract data from the Service beyond what is provided through the official API.
- Attempt to gain unauthorized access to other tenant accounts, the Service's servers, or any systems connected to the Service.
- Transmit malware, viruses, or any other malicious code through the Service.
- Use the Service to send unsolicited communications (spam) to end customers.
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
6. Data Ownership
You retain full ownership of all booking data, customer information, and business content that you or your customers create or upload through the Service ("Tenant Data"). We do not claim ownership of your Tenant Data. We host and process your Tenant Data solely to provide the Service to you. You may export or request deletion of your Tenant Data at any time.
7. API & MCP Usage
Access to the HyperXI API and MCP server is provided as part of eligible subscription plans. API and MCP usage is subject to rate limits, which may vary by plan tier. You agree to use the API and MCP access in accordance with fair use principles and not to exceed reasonable request volumes.
You may not resell, sublicense, or redistribute API or MCP access to third parties. You may build integrations for your own business use. If you wish to build a product or service on top of the HyperXI API for distribution to others, you must obtain written permission from us.
8. Intellectual Property
The HyperXI platform, including its software, design, branding, documentation, and all related intellectual property, is owned by Escape Tech Enterprises LLC. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.
You retain ownership of all content, data, and materials that you create or upload through the Service. By using the Service, you grant us a limited license to host, store, and process your content solely for the purpose of providing the Service.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Escape Tech Enterprises LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Service.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim. The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
10. Termination
You may terminate your account at any time by contacting us or through your account settings. We may suspend or terminate your access to the Service if you violate these Terms, fail to pay applicable fees, or if we determine that your use poses a risk to the Service or other users.
Upon termination, your right to use the Service ceases immediately. We will retain your Tenant Data for a 90-day grace period following termination, during which you may request an export. After the grace period, your data will be permanently deleted.
11. Changes to Terms
We may update these Terms of Service from time to time. When we make material changes, we will notify you by email or through a notice within the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated terms.
